Ever wonder how your cable company made its choices about what stations it would carry, and thus which stations you would be able to see? Here's the official list of stations which were permitted to be delivered by satellite, in Canada, as of 22 July 1997. Each cable company made its selections from this list. (Terrestrial delivery methods, such as microwave and optical fibre -- and even over-the-air and couriered videotape, the delivery methods mainly used in the 1970s and 80s -- were not limited to this list.)

Revised Lists of Eligible Satellite Services

CRTC Public Notice 1997-96 included the following lists, up-to-date as of 22 July 1977, of television services authorized for distribution by satellite in Canada.

There was no Part I list. The Part II list contains satellite television services authorized for distribution on a "discretionary basis" (which meant that the cable company got to decide which of these services would made available on any particular cable system -- the individual customer and the public at large had no part in this decision) by a cable company holding a Class 1 licence (with 6,000 or more subscribers) or a Class 2 licence (with 2,000 to 6,000 subscribers). It is divided into Sections A and B. "Non-Canadian satellite services in Section A may be packaged with either Canadian pay television or specialty services. Non-Canadian satellite services in Section B may be packaged only with a Canadian pay television service."

The Part III list contains satellite television services which were authorized for distribution by cable companies holding Part III licences, or cable companies holding a Class 2 licence (with fewer than 2,000 subscribers).

At this time, the non-Canadian services in the Part II list, and Part III non-Canadian list, were identical. So that that all cable distribution companies would be permitted to distribute the same non-Canadian satellite services, any new service added to the Part II list (whether in Section "A" or "B") was also added to the Part III non-Canadian list.

Cable companies are not permitted to package Playboy TV in such a way that subscribers are obligated to purchase Playboy TV in order to purchase any other programming service. Cable companies are required to take measures to fully block the reception of both the audio and video portions of Playboy TV to subscribers that request it not be receivable in their home (in either unscrambled or scrambled analog form).

Cable companies that distribute a PBS signal received at the local head end by terrestrial transmission may distribute one PBS service received from Cancom. All other cable comapnies may distribute a maximum of two PBS services received from Cancom. Cable companies may not distribute a duplicate signal of a commercial U.S. network, received from Cancom, unless otherwise authorized in the broadcasting licence.

Note P2: Playboy TV is only authorized for distribution at the specific request of a subscriber. Cable companies are not permitted to package Playboy TV in such a way that subscribers are obligated to purchase Playboy TV in order to purchase any other programming service. Cable companies are required to take measures to fully block the reception of both the audio and video portions of Playboy TV to subscribers that request it not be receivable in their home (in either unscrambled or scrambled analog form).

In the case of CFTO-TV, CFTM-TV, CFCF-TV, CHAN-TV and CJON-TV, a cable company also distributing the signal of a local TVA or CTV affiliate shall delete the duplicate programming from the Cancom services or substitute the local service(s) when the programming is identical.

Cable companies that distribute a PBS signal received at the local head end by terrestrial transmission may distribute one PBS service received from Cancom (Canadian Satellite Communications Inc.). All other cable companies may distribute a maximum of two PBS services received from Cancom. In Public Notice CRTC 1996-122 dated 4 September 1996, the Canadian Radio-television and Telecommunications Commission announced that it was prepared to consider requests from Canadian "sponsors" to add non-Canadian satellite services to the lists of eligible satellite services. In its notice, the Commission stated that such requests should be accompanied by evidence that the non-Canadian service has agreed to be sponsored by the Canadian party filing the request, and should include a statement from the service provider that it has obtained all of the necessary Canadian distribution rights for its programming. Sponsors were also directed to provide a brief description of the service, a copy of the current program schedule, and evidence of discussions with distributors with respect to potential demand for the service.
